  • Who to Ask for Permission to Use a Photo

    I had the pleasure of speaking at TechPhx over the weekend and fielding a lot of questions about how the law applies to blogging and podcasting, especially copyright, trademark, and privacy issues. The big take-home lesson surrounding copyright is usually “get permission” to use a photo on your site by using images from Creative Commons or asking the copyright holder for permission to use their work. (I’ve never had anyone tell me “no.”)

    But what do you do if there’s an image you want to use and you can’t tell who the copyright holder is to ask permission?

    I would start by evaluating the situation where I found the photo and contact the website administrator if it’s on a website or the profile owner if it’s on a social media site and say something like, “This picture is really beautiful. Who took the photo?” or “Where did you find this photo?” I probably wouldn’t ask, “Who is the copyright holder?” because a lot of people don’t understand copyright law and they think that owning a photo or having a copy of the file means they own the copyright, when they don’t.

    I saw a situation where a publication asked a person if they could use some of the photos she posted on her social media site in an upcoming edition and she said “yes.” Unfortunately, that person wasn’t the copyright holder and she didn’t understand that she didn’t have the authority to give such permission. The publication thought they did everything right but because they didn’t verify they had permission from the copyright holder, they had a bit of a mess to fix once the photographer learned what had happened and informed the publication that they used his work without his permission.

    Another tactic I might use if I wanted to find a copyright holder is run the photo through the Google Image search engine to see where else the image is available online. That might reveal the original source.

  • Avoid Copyright Infringement in your Social Media Posts

    The other day I smiled when I saw a friend put a post on Facebook that included a Creative Commons attribution. He was the person who taught me how important it is, just from the perspective of respect, to get permission before posting another person’s work on your social media page. This was before I studied and fell in love with copyright.

    Now, it warms my little lawyer heart to see someone respecting copyright.

    And I finally have time to read Gary Vaynerchuk’s book Jab, Jab, Jab, Right Hook, which is filled with helpful information on how to market your business and excellent demonstrative case studies. One of his lessons is to use each platform to suit the needs to the users. So if a site is visually-focused, like Facebook or Pinterest, you want to create posts that have images that will provide users value and hopefully they’ll share them. His book has great examples of how companies are doing this effectively and what habits you shouldn’t emulate.

    This is when the red flag went up for me.

    If a company’s marketing department created a photo, there’s no problem with copyright. But if a company is using someone else’s photo (because companies don’t just have to talk about themselves online), they have to deal with the question of whether they have permission to use the image in question.

    A lot of companies appear to be thoughtful about making sure they are using their own photos or finding images via Creative Commons for their website or blog. However, they don’t apply the same standards to their social media posts. If you’re doing this, and pulling images from other site without getting permission from the copyright owner, you could be setting your company up to be accused of copyright infringement and face a cease and desist letter, a DMCA takedown notice, a bill, or possibly a lawsuit.

    Legal Side of Blogging Book CoverI’ve been inspired by people who use social media effectively and find amazing images to incorporate into their posts. I hope to create more content on social media that’s worth sharing. If you’re in my boat, please make sure to use images you own or use Creative Commons. When I use Creative Commons, I only pull images that come with a license that let me modify (aka crop them) and commercialize them. And even on social media, give your photographer the attribution. You may be legally obligated to do it, and it’s also a sign of respect for their work.

  • What Should You Do If Someone Steals Your Work

    Copyright infringement appears to be rampant on the internet. Some people don’t understand that they can’t use anything they find online. They don’t understand that the law lets the copyright holder dictate where their work is displayed and distributed. Some people get defensive when they get caught and say you should be happy that you’re giving them exposure.  Others know it’s illegal and take the gamble that you won’t notice or that you won’t object if you see what they’ve done.

    Make Sure It’s Your Work They Copied
    People don’t always own what they think they own. Check your contracts to verify that you are the copyright owner and not just the creator of a work. Remember – employees don’t own the copyright in anything they create within the scope of their job but independent contractors retain the copyright in anything they create unless there’s a written copyright assignment or work made for hire contract. Additionally, two artists can independently come up with similar ideas for original works and it may not be problematic so long as they’re only claiming rights in what they created.

    How Do You Want This To End?
    This is the question I ask all my clients who are in a suspected intellectual property infringement situation. Their goal determines my course of action. Ideally you should determine how you want to react to infringement before it occurs so you can lay the foundation in advance for your desired outcome.

    If you just want the infringer to take down your work, you can respond with one of the following:

    If you want the alleged infringer to pay you for using your work you can send a bill or sue them for infringement. If you want to pursue one of these options, you definitely want to use a lawyer to contact the alleged infringer on your behalf or through the court.

    If you’re OK with the person using your work, you should send them a notice that gives them permission and requests they ask permission before using your work in the future. You always want to respond when you suspect someone is using your work without consent. Otherwise you could create the impression that you’ve attached a blanket license for anyone to use your work which could hurt your chances of going after other suspected infringers in the future.

    Please note – you can send a notice without being a jerk about it. Jack Daniel’s sent what’s been referred to as the nicest cease and desist letter when an author copied Jack Daniel’s label on his book cover.  You could write or ask your attorney to do something similar

  • What to do if You’re Accused of Copyright Infringement

    The owner of a copyright has the exclusive right to control where their work is copied, displayed, and distributed. If they think that someone is using their work without permission, there’s a good chance they’re going to react. They may be passive aggressive and write a blog post about you. They might b direct and send you an email or call you. If they sell their work for a living, they may just send you a bill. They may also hire a lawyer to send a cease and desist letter, a DMCA takedown notice to your webhost, or they may just sue you.

    If you are accused of violating someone’s copyright, the first thing you want to do is examine the situation. What are they claiming is on your site or your materials that belongs to them? Some people will tell you that you can use anything you find on the internet as long as you provide and attribution and a link to the original – and that’s just not true. What you may have done is commit infringement and admit it. So look at the image or text in question and try to determine where it came from. If you created it from scratch, there’s a good chance it’s not infringement. If you got it from someone else, you may have a problem.

    In most cases, it’s a good idea to schedule an appointment with your copyright lawyer if you’re accused of committing infringement, especially if the other side contacted you through their lawyer. He/she can examine the situation, explain your options, and help you choose the right course of action for your situation. In most cases, the person who claims you stole their work doesn’t want to sue you. They likely want you to stop using their material, and possibly pay a licensing fee for the time you used it. In many cases you want to respond either as yourself or through your lawyer with what you did or could do to resolve the situation.

    There are times where you might want to risk not responding. Some people do this is they think nothing will happen if they ignore the notice from the person claiming you stole their work. Sometimes this is effective. Sometimes it leads the person to escalate and sue you or report your company to a regulatory body that oversees your company. It’s not a decision to make lightly.

    So what are the best and worse-case scenarios in these situations? In the best-case scenario, the person making the claim against you is wrong because you haven’t violated their copyright sending a response to that end or ignoring them will resolve the situation. In the worst-case scenario, you’ll be sued (and lose!) for willfully stealing someone’s copyright and sued for $150,000 per image or article you stole, plus the copyright holder’s attorney’s fees.

    Legal Side of Blogging Book CoverBecause the penalties can be so high, you want to be careful when you use other people’s content on your website or marketing materials. You need to be sure that you own or have permission to use content created by third parties.

  • Telling the Truth when you get Free Stuff

    One of the perks of being a blogger is sometimes you get free stuff. Companies will send you free things with the hopes that you’ll write about it. One of my writing gigs is product reviews for lawyers so I have to use various office gadgets and software and write about it.

    If you are lucky enough to get free stuff in the mail or you review products as part of your job, there are some rules you need to know. By federal law, you have to do two things if you do product reviews:

    Your review of the product must contain your true opinion about it that is not misleading.

    You must disclose when you are compensated for giving your opinion.

    This means that you have to be honest about what you think about a product and not feel compelled to say nice things just because you got it for free or paid for the review. And you have to tell the audience that you got a benefit for the review – perhaps so they can be aware of the potential bias. The disclosure doesn’t have to be a big deal – just a “XYZ sent me this product for free and here’s what I think about it.”

    If you don’t follow this rule, you could be fined up to $11,000 by the Federal Trade Commission. They can go after the reviewer or the company who sent the product. I suspect they’ll go after who has money to pay the fine.

    Legal Side of Blogging Book CoverA company that sends out free products to bloggers or reviewers should include a reminder to their reviewers that they need to comply with this rule. This rule also applies if you’re writing comments on other blogs or websites or writing original content for your own site.

    This rule also applies to review sites like Yelp and Trip Advisor. If you’re a Yelper, your must only post accurate reviews and you can only review products and services you’ve used. A company can’t legally tell its employees to post exaggerating positive reviews about the company or fake negative reviews about their competition.

  • Questions People Ask About the Law, Photos, Sex Tapes, and Revenge Porn

    The movie Sex Tape comes out this week. The previews look dumb, but I want to see it to examine the story from a legal perspective.

    I’ve done a fair amount of research and writing about cyber harassment and “revenge porn.” I’m generally an advocate of personal responsibility and people not acting like asses, but judging by the terms people search for and end up on my site, a lot of people don’t share my views.

    Here is a sample of the terms people have searched for and ended up on my site just in the last ninety days. (I corrected the spelling errors unless they were too funny not to leave in.)

    I get a lot of hits on my site when people search for terms like this:

    • Can someone post your picture without permission
    • Can I sue someone for posting pictures of me online
    • If someone sends you a photo via phone can you post it online
    • Is it illegal to take a picture of someone and post it on the internet
    • Sex tape invasion of privacy
    • Expectation of privacy in sex stores
    • How to get a sex tape of you removed from a website?

    I feel bad for these people:

    • What if someone wants to post your explicit pictures
    • Someone is threatening to put me on a porn site
    • My daughter videotaped herself doing some sexual things and now someone is threatening to put it on the internet what now
    • Someone posted nude pics of me, what type of lawyer do I need
    • Girlfriend took illegal pictures and put them on Facebook
    • If a site posts my porn video can I make them take it down
    • My ex-husband has intimate pictures of me what can I do
    • What is the legal steps you can take when someone is distributing a sex tape of you without your consent
    • My ex-boyfriend has nude pics of me. Can I legally do anything to make him delete them?
    • Can I get someone arrested for posting nude pictures of me online
    • Can you get someone arrested for distributing a sex tape?
    • Can you be classified as a sex offender for posting nudes on Facebook Arizona

    These people kind of scare me because they either sound vindictive or clueless:

    • Wapsites to post my nude pics
    • Took photos of my ex naked while she was passed out
    • Can I post pics of my ex online
    • Can I post a naked pic on the internet without the consent of that person
    • If a person uploads sex videos in prone sites how much money will he get
    • Do you allow people to post nude pictures on your site I broke up with a guy
    • If u put wife nude video with name on internet can u get in trouble
    • Is giving out naked pictures of your ex- girlfriend breaking the law
    • Can you send xrated pics to get back at someone
    • Is it illegal to take a picture of someone and caption it with a degrading comment

    These are just funny:

    • Can you sue a person for taking a photo of your butt in public
    • My ex sent me nude pics can I prosicute her
    • What to do to keep ur man after he saw ur nude pics sent to an ex
    • My boyfriend exposed my nude pictures. I will arrest him
    • Can you take pictures of people having public sex?
    • How to legally make fun of people on the internet
    • Why do people post stupid things online

    Anyone who’s a regular reader knows that I constantly say “Think before you post.” When it comes to taking explicit photos or videos with your significant other, don’t do it unless you can handle the responsibility and have enough integrity to keep your private life private.

  • How to Avoid Being the Next Social Media Horror Story

    I had the pleasure of presenting Social Media Horror Stories (and How to Avoid the Same Fate) at the Arizona Technology Council Lunch and Learn this week.  For those of you who weren’t there, I got to tell the stories of major missteps companies and individuals have committed with their social media activities and how to avoid the same mistakes. In every situation, the problems could have been avoided or mitigated with proper education, forethought, and applying common sense.

    This is my recommended follow-up plan for attendees:

    Register Your Trademarks
    To avoid problems with your competition, register the name of your company, products, blog, logo, and/or tagline with the U.S. Patent and Trademark Office. Without registration, the law only protects your right to use your trademarks in your established geographic market (which can be challenging to discern when your business is 100% online). You don’t want to find yourself in the Burger King situation where your market is limited or the Turner Barr situation where your business is essentially shut down because someone else registered your mark.

    Before you launch your next company, product, or marketing campaign, be sure to check the Trademark Office’s database to make sure that someone else doesn’t already have the exclusive rights to use your desired trademark.

    Check Your Contracts
    If you outsource any of your content creation or marketing activities, review your contracts carefully. Look for information about who owns the social media accounts and any content created on your behalf. Also look for provisions that address potential problems and whether you will be indemnified if you’re sued or get in trouble because of something a third party did on your behalf.

    Remember that website terms of service are also contracts. Make sure you understand the implications of using a social media platform or web-based service. Your site may also have terms of service that manage your relationships with your users. Make sure they’ve been written to suit your needs.

    Be Careful About Copyrights
    When a person owns a copyright in text or an image, they have the exclusive right to control where they work is copied, distributed, and displayed. If you want to use their work, you often need to obtain permission or risk being accused of copyright infringement.  I frequently see people pulling images from search engine results without considering the artist’s rights. Many people think they can use whatever they want as long as they give an attribution and link back to the original, and that’s just not true. If you’re looking for images for your site, consider using Creative Commons. I always use images that come with the license that allows me to modify and commercialize the artist’s work.

    When it comes to your own copyrights, decide in advance how you want to react when someone steals your work and plan accordingly.

    Check Your Social Media Policy
    I’m an advocate for the idea that companies should generally leave their employees alone when they’re on their own time, including what they do on social media. However, I’m also a huge proponent of the idea that every company needs a social media policy. Employees need to understand what their dos and don’ts are when it comes to their personal profiles and blogs, and employers need to understand that their social media policy needs to comply with the National Labor Relations Act. If your policy prohibits employees from saying anything damaging about the company online, it’s likely illegal and if you fire someone for violating an illegal policy, you could easily face tens of thousands of dollars in legal fees and damages. This is an area of law that is still developing, so please have  lawyer help you write your policy so it complies with the law.

    Review Your Crisis Response Plan
    For most companies, the question isn’t if it will face a crisis, but when. Every company should have plans in place for dealing with expected problems, including pre-writing content for the media and social media, so what when an problem occurs, everyone knows what their role and the protocol that everyone will be following. When you’re having your planning sessions, it’s a good idea to have your legal counsel present to assist from a legal perspective.

  • What was up with General Mills’ Legal Terms?

    I got lots of messages last week when it came out that General Mills’ legal terms said that if you downloaded their coupons, connected with them on social media, entered a contest, or purchased any of their products that you agreed to resolve all disputes with the company through binding arbitration or informal negotiation via email.

    And everybody lost their minds.

    I can understand requiring arbitration for disputes related to contests. I write terms of service for websites all the time and I also include a dispute resolution where my client specifies where, how, and using which state’s law problems will be resolved. I would never tell a client to write their terms in a way that dictates how they’re going to resolve problems that are not related to a website.

    I think it’s ridiculous that they’d even try to tell consumers that making a purchase forces them to resolve disputes in arbitration unless those provisions are available on the packaging and in print that might make a consumer take notice. I’ve never thought to examine a cereal box for contract terms.

    Thankfully General Mills saw the light and reversed its decision and voided the offensive terms this past Saturday. In a blog post, General Mills spokesperson Kirstie Foster wrote, “No one is precluded from suing us by purchasing our products at a store, and no one is precluded from suing us when they ‘like’ one of our Facebook pages.”

    General Mills still supports arbitration for resolving disputes and I understand why. It can be a faster and more cost-effective way to resolve problems. However, some disputes are better left to litigation where there is the option to pursue a class-action lawsuit when the situation warrants it.

    We agree to contract terms all the time. Every time we click the “I agree” button for an online service or to create an account on a social media platform, we are agreeing to the terms of the contract (even if we don’t read the terms). The next time you go to a concert or a professional sporting event, flip over your ticket and read the fine print on the back. That’s a contract. I have no problem with these contracts as long as they make sense for the situation and don’t overreach into scenarios where it would be unreasonable for the terms to extend.

    For example, I recently heard that there was a sign at a Whataburger restaurant that put consumers on notice that by eating in the restaurant, they agreed to resolve all disputes related to their dining experience via arbitration. I tried to confirm this but I didn’t see such a sign in my neighborhood Whataburger. I visited their website and didn’t see such a provision; however, I was perturbed to see terms and conditions that said:

    By giving us permission to use your post or tweet, you agree that we may, at our discretion, use your real or social media user name and the content of your post or tweet (including all accompanying images) on our website to promote our company, products and services for such time period as we wish. You give us the right to edit your post or tweet for brevity, clarity and the like and to modify any image in any manner we deem necessary to use it on our website. You will not have the advance right to review or approve what we post on our website….You will not receive any compensation for granting us the above rights. We agree that you may withdraw the permission you have given us at any time by sending us an email at customerrelations@wbhq.com.

    Whataburger’s Facebook page says they can use anything you post on their page but I didn’t see any similar verbiage on their Twitter profile. I think they’re trying to set themselves up so they can use anything you post about the company on social media, including editing it which I’m not too keen about the verbiage they used.

    This is a topic that is worth watching to see what becomes the norm in social media marketing.   • New Trial in Crystal Cox Defamation Case – What Does It Mean for Bloggers?

    The Ninth Circuit Court of Appeals recently ruled that Crystal Cox will get a new trial for the defamation lawsuit that was filed against her. Cox calls herself an “investigative blogger” and she wrote a blog post where she accused Oregon bankruptcy attorney Kevin Padrick and his company, Obsidian Finance Group LLC of committing “fraud, corruption, money-laundering and other illegal activities.” Padrick sued Cox for defamation and an Oregon court awarded him $2.5 million in damages.

    In general, defamation requires a false statement about a person communicated to a third party that hurts that person’s reputation. Based on this definition, it’s easy to see how a blogger could be accused of defamation if someone suspects the blogger is lying about them in a post. The court applies different standards for different situations involving situations which will affect whether the author has committed defamation and what damages can be awarded.

    A court may award compensatory damages to make up for the person’s damaged reputation and punitive damages to punish the person who committed the defamation.

    Here are the three standards that can apply in a defamation case.

    • Defamation of a public person: The alleged victim must prove that the author knew or should have known they were lying when they made the statement in question – only compensatory damages available.
    • Defamation of a private person regarding a manner of public concern: Punitive damages are available in addition to compensatory damages if the alleged victim can prove that the author was negligent in making the statement.
    • Defamation of a private person regarding a matter that is not of public concern: Compensatory and punitive damages are available if the alleged victim can show that the statement was false and damaged their reputation.

    It appears the lower court applied the standard for defamation of a private person regarding a matter that is not of public concern and the court of appeals ruled that they should have used the standard for defamation of a private person regarding a manner of public concern because the public has an interest regarding whether an attorney is corrupt and committing fraud. So the parties will have to settle the case between themselves or have a new trial and use the correct standard. But note, there is no dispute about whether the statement in question was defamatory, only what standard the court is supposed to use to decide the case.

    Some people are calling this ruling a huge victory for bloggers because it states that the same defamation standards for journalists apply to blogging – and I’m going to respectfully disagree.  The landmark defamation cases may have started with journalists, but we don’t have different defamation laws for journalists and everyone else. (If this were a Shield Law case, it would be different.) There have been other defamation cases against non-journalists where the court applied the same standards. The fact that this might be the first time a court has said that bloggers can write about matters of public concern is an indicator of how few defamation cases go to trial more than anything else. No real new information has come out of this ruling by the Ninth Circuit.

    This case is a good reminder about where you can be sued because of your blog. If you do something wrong via your blog and you get sued, the alleged victim is going to sue you in their state and under their state’s laws. In this case, Cox was living in Montana when she made the original statements and she had to travel to Oregon to defend herself under Oregon’s laws.

  • What the Yelp Lawsuits Mean for You

    There are a few lawsuits going on right now involving reviews on Yelp. If you are a business owner who is concerned about what people might post about you or a person who likes to post reviews of products and services online, you should be paying attention.

    In the first case, the court ordered Yelp to reveal the identities of seven anonymous account holders who are being accused of posting false negative reviews about a business. The owner of Hadeed Carpet Cleaning filed the defamation lawsuit claiming that these people were not customers. Posting reviews of companies you haven’t used is also a violation of Yelp’s terms of service.

    The First Amendment protects people’s right to share their opinions, including anonymously. However, it doesn’t protect against defamatory speech. The challenge with anonymous speech is you could be unmasked if you do something wrong or if someone builds a strong case that you could be wrong. These cases are hard because the owner doesn’t know who is posting the anonymous review so they can’t cross check the review with their customer records so they often have to sue to identify the person so they can determine if they’ve been illegally harmed.  This case doesn’t concern me too much as long as the court is applying the proper standards to determine if the plaintiff has shown enough evidence of harm that would warrant a subpoena to reveal the posters’ identities.

    In the second case, a contracting company is suing a former customer for $750K for defamation after she posted a negative review on Yelp where she claimed her “home was damaged, she was billed for work that wasn’t done and jewelry went missing after she hired” the company. Defamation generally requires a false statement about a person or entity that’s communicated to a third party, and that hurts the person or entity’s reputation. In this case, the owner claims the review has cost his company business, so there’s his damage. If anything in her review is untrue and led to the drop in business, that’s likely defamation.

    Some people are concerned that these cases will prohibit people from posting negative reviews online, even when they are accurate. Given how many Yelp reviews have been posted and how few lawsuits have come out of them, I don’t think this should be a significant concern for Yelpers. I think these cases provide good lessons regarding internet law and etiquette:

    1. If you’re going to post reviews online, make sure you only share your accurate opinion. (BTW – Federal law requires you to only post your honest and accurate opinions.)
    2. The First Amendment protects your right to speak anonymously; however, if someone suspects your speech has harmed them, they may have to sue to get a subpoena for the website to reveal your identity to determine if they’ve been harmed. If you use your real name, they can cross check your review with their records.
    3. If you are a business owner, take care of your customers. If you treat them badly, have low quality products, or provide poor service, they will call you out online.

    Most states have laws against strategic lawsuits against public participation, called anti-SLAPP laws. These are laws against filing lawsuits that are intended just to shut you up, not to address a situation where a person was legally harmed. If someone files a defamation lawsuit against you because of an online review and you feel like you’re being falsely accused, you should check to see if your state has an anti-SLAPP law.
